GENERAL TERMS AND CONDITIONS (GTC) for

Chiropodists, beauticians, (therapeutic) masseurs, nail studios, piercers and tattooists

  • 1. general

These General Terms and Conditions (hereinafter referred to as “GTC”) apply to all contracts and services (services, sale of goods, contract initiation, etc.) between the company Glowing Point RHI GmbH Filiale Hauseggerstraße 56 b in 8020 Graz, www. Glowingpoint.at with the e-mail info@glowingpoint.at (hereinafter referred to as “Service Provider”) and its customer. Legal transactions between the service provider and the customer that are not covered by these GTC require an individual written agreement. Verbal collateral agreements are invalid. Other GTC shall not apply.

  • 2. conclusion of contract and appointment

2.1. Any service descriptions and the advertising of services and products (in the business premises, in advertising brochures, on the website or similar) are non-binding and subject to change, i.e. they represent an invitation to the customer to submit an offer. The service provider may accept or reject offers (in particular for appointments) without giving reasons. Offers can be made by telephone, email, online or in person (see contact details at the end).

2.2. Offers are accepted by the service provider by sending a confirmation SMS, confirmation e-mail or express personal confirmation.

  • 3. postponements, cancellations, late arrival at the agreed date

3.1. Agreed appointments are binding and must be kept. If an agreed appointment cannot be kept by the customer, a cancellation or postponement is only possible in accordance with the following regulations.

3.2. Appointments can be postponed or canceled free of charge (cancellation) up to 3 days before the appointment, not counting Saturdays and Sundays. If the appointment is postponed or canceled after this time but at least 48 hours before the agreed appointment, the service provider may charge a cancellation fee of 50% of the agreed fee. If the appointment is postponed or canceled even later or in the event that the customer does not keep the agreed appointment, the service provider shall charge the entire fee. The customer shall not be entitled to compensation.

3.3. No reimbursement/discount can be granted for a reduction/reduction in the agreed service requested by the customer.

3.4. If the service provider is unable to meet an appointment for reasons for which it is not responsible or due to force majeure, the customer shall be informed immediately, provided that the contact details provided allow for prompt contact. In such a case, the service provider is entitled to postpone the appointment at short notice or withdraw from the contract.

  • 4 Prices and payment modalities

4.1. All prices are based on the price list valid at the time the service is provided. The publication of a new price list automatically replaces the previous price list.

4.2. The fee for the service used by the customer is due for payment immediately after provision by the service provider.

4.3. The fee for a series of services (block of 5/10/x) must be paid in advance. The block of 5/10/x is not transferable to third parties.

4.4. Refunds for services paid for in advance (vouchers, blocks) are not possible.

  • 5 Damage to property

The service provider’s liability for damage to property in the course of providing the service (e.g. to the customer’s clothing due to oils, creams or similar liquids, etc.) is limited to gross negligence and intentional acts.

  • 6 Retention of title

The service provider retains ownership of the goods sold until they have been paid for in full.

  • 7 Obligation of the customer to provide information

7.1. The customer is obliged to inform the service provider to the best of his knowledge and belief of any illnesses, allergies or other physical complaints (in particular diabetes, blood thinning, etc.) which must be taken into account when the service provider provides the service or which could lead to an impairment of the customer’s health.

7.2. The customer shall answer the service provider’s questions about their state of health conscientiously and truthfully in order to avoid complications in the provision of the service and possible damage.

  • 8 vouchers

8.1. Value vouchers are issued for a specific amount of money. The vouchers are valid for 5 years, whereby the service corresponding to the redemption of the voucher must be provided within this period. The provisions agreed under § 2 and 3 on making appointments apply to redemption.

8.2. Service vouchers are issued for a specific service. Service vouchers are valid for 5 years, whereby the service corresponding to the redemption of the voucher must be provided within this period. The provisions agreed under §§ 2 and 3 on making appointments apply to the redemption of vouchers. If the price of the corresponding service at the time of redemption is higher than at the time the voucher was issued, the customer must pay the difference.

8.3. The voucher must be brought to the appointment and can only be redeemed against validation.

8.4. Payment of the voucher value (cash redemption) is excluded.

Should one or more provisions contained in these GTC be void or ineffective or lose their effectiveness due to later circumstances, this shall not affect the validity of the remaining provisions. In this case, the contracting parties undertake to effectively supplement the contract with a provision that corresponds to the legal and economic purpose of the invalid or incomplete provisions.
